At Neopets, we’re excited to announce the start of our Neopets Fan Art Program!

What is that, you say?

The Neopets Fan Art Program is an exciting initiative to support the amazing artists within our community!

At Neopets, we value creative expression and you’re the reason we have such a vibrant and colourful world to enjoy!

Currently, it is against Neopets policy to sell or profit from Neopets-inspired art.

However, after listening to our community, and with assistance from our Community Ambassadors, this rule no longer reflects our goal to nurture our fellow artists! We want to inspire our creative community, not discourage it.

What exactly is the Neopets Fan Art Program?

The Neopets Fan Art Program will be a platform to showcase trusted and approved sellers who create quality Neopets-inspired artwork. This means approved sellers can legitimately sell digital Neopets products and commissions for real-world currency, with support directly from Neopets.

We’ll be able to direct the community to purchase from approved sellers to help protect players and customers from potential scams and fraudulent purchases.

Approved sellers will be featured on a dedicated page directly on Neopets.com, with an opportunity to share your work and build connections with potential clients and customers! There, we’ll be able to link visitors to your store to purchase directly, meaning you won’t have to worry about any fees from Neopets! Your earnings will be 100% your own. This will also protect you and give you confidence in providing your services without risk of copyright infringement or rule violations on your Neopets account.

Am I qualified to join the program?

Have we piqued your interest? Wonderful! To get involved, The Neopets Team must determine if you qualify as an approved seller.

To qualify, you need to:

Create your own art! This might seem obvious, but original artwork is essential! Your work must also adhere to the creative guidelines, which we will explain below!
Set up an online store from one of our approved platforms - Shoppy, Etsy or Ko-Fi. This store must be a stand-alone Neopets store, where only approved Neopets products are listed.
Earn less than $2,000 per month or $20,000 per annum from sales from your store. If you start earning more than this, you’ll need to apply to become an official licensee.
Submit your store to us for assessment.
Agree to our Terms and Conditions & Guidelines.
Uphold our community standards as a seller. This includes how you respond to complaints, handle issues that may arise, and deliver on commitments. We expect all authorised sellers to operate with professionalism, including responding with respect and compassion, handling all sales-related issues that may arise with care, and deliver on commitments in a timely manner. We may need to remove your store if this criteria is not followed consistently.

What can I sell?

Excellent question!

As an authorised seller, you can sell any digital products except Neocash Cards. This includes:

Digital Neopets commissions
Graphics and layouts (official Neopets imagery like pet images are allowed in graphics only)
Digital assets like backgrounds, wallpapers, phone and tablet icons
Digital patterns for physical products, like knitting patterns or sewing patterns
Digital colouring pages

But what about handmade art?

Our community is free to create handmade Neopets-inspired products for personal use. Due to the nature of our licensing contracts, we prohibit the sale of products for commercial use. In an effort to protect our licensees, we will not be accepting physical merchandise such as apparel, pins, and plushies in the Neopets Fan Art Program.

If you wish to sell physical Neopets products, you’ll need to apply to become a licensee.

How do I become part of the program?

So now you’re excited to be a part of the program! Praise Fyora! That’s the first big step to joining this awesome adventure with us!

You’ll need to complete a few steps to become an authorised seller:

Create a store on an approved platform. Upload at least three listings that contain Neopets products only!
Complete the submission form.
Wait for a decision from The Neopets Team - it can take up to 2 weeks!
Once approved, we’ll list you on our website under ‘authorised sellers’! Hooray!

What are the guidelines for becoming an authorised seller?

To become a successful seller in our Fan Art Program, your store needs to follow some guidelines. This is to keep you and buyers safe and ensure the products sold support our vision for Neopets.

Do:

Ensure your store is hosted via Etsy, Ko-Fi, or Shoppy.
Make sure to create original, fun, and creative work directly related to NEOPETS.
Ensure all submissions are for DIGITAL products only.
Ensure your store sells Neopets ONLY items. Sorry, no crossovers!
Ensure all submissions are appropriate and site-friendly.
Make sure you include NEOPETS in the title and description of your artwork to help fans find your awesome artwork!
Be sure to include other relevant terms in the title and description of your work when applicable - like character names, places, etc.
Create original drawings of the characters.
Use the official logos, but do not stretch or modify the logos.
Add ‘(c)’ after the NEOPETS logo if it is incorporated into your artwork.

Don’t:

Do not recreate existing NEOPETS merchandise or use elements created by other artists.
Do not incorporate any third-party content into your artwork, and don’t include mash-ups of NEOPETS with other content owners’ properties or brands (memes acceptable provided appropriate).
Do not use official NEOPETS artwork or traced imagery in your design.
Do not use NEOPETS to advertise any businesses, products, events or services of any party.
Do not submit offensive designs - avoid hateful, divisive, and adult content in your artwork. Contact us for an explicit list.
Do not submit stores that contain NON-NEOPETS products.
Do not sell Neocash cards.

What happens after I am accepted into the program?

After you become part of our authorised sellers, your store link will be published under the Fan Art Program. We will continue to review all sellers to ensure products adhere to the guidelines, and may contact sellers to discuss changes or adjustments.

You will be in control of all sales made on your store, including determining your own prices, profits, and policies of purchase. Neopets will not obtain, acquire or otherwise accept payments on behalf of authorised sellers, nor will we require sales to be made through us. This ensures that authorised sellers still maintain autonomy across their online stores, while our role is to support and promote sellers we believe uphold the creative and community standards we envision for Neopets.

As an authorised seller, if you or a buyer encounter any issues or concerns that cannot be resolved, you can contact us via community@neopetsmeta.io for assistance. You do not need to escalate issues via tickets or our support staff.

What happens if I am NOT accepted into the program?

We understand this may happen and that it is disappointing! There are a few reasons why you may not be accepted into the program, including:

Your store or products do not adhere to guidelines
We are at capacity for authorised sellers at the time
We identified an issue regarding your application and may need clarification

If you’re not accepted or we need more information, we’ll let you know through our assessment process when you receive the outcome. There, we can work towards a resolution!

Neopets ‘Fan Art Program’ Submission Terms and Conditions

By making a Submission (as defined below) to the Neopets Fan Art Program, you agree to be bound by all the terms and conditions below.

1. Definitions

a. “Artist Guidelines” means the additional terms and conditions applicable to your use of the Licensed Property in your Submission, which are available at the following URL: [coming soon!]

b. “Agreement” means these terms and conditions, the Artist Guidelines, and the Neopets User Agreement which are incorporated by reference into the Agreement.

c. “Licensor” means Neopets, World of Neopia, Inc. and its subsidiary World of Neopets Limited, (based on your location)

d. “Licensed Product” means a physical product displaying your Submission that you sell or offer for sale on the Neopets Fan Art Program.

e. “Licensed Property” means artwork, characters, character names, titles, logos, design elements, and all other intellectual property that are exclusively owned or controlled by Licensor and which Licensor has explicitly permitted you to use in your Submission in accordance with the terms and conditions of the Agreement.

f. “Neopets” means World of Neopia, Inc. and its subsidiary World of Neopets Limited.

g. “Neopets User Agreement” means the terms and conditions applicable to your use of the Neopets Fan Art Program, which are available at the following URL: https://www.neopets.com/settings/about/terms/.

h. “Neopets Fan Art Program” means the online marketplace owned and operated by Neopets, which is located at Neopets.com.

i. “Submission” means an original work created by you that (i) is based on or incorporates the Licensed Property, and (ii) you have uploaded to the Neopets Fan Art Program in order to sell Licensed Products.

2. Submission Condition

a. You agree that your Submission will at all times comply with these terms and conditions, the Artist Guidelines and the Neopets User Agreement.

b. You agree that the license granting you permission to use the Licensed Property extends only to the Neopets Fan Art Program, and that you may only sell or offer to sell Licensed Products on the Neopets Fan Art Program and nowhere else, whether online or in a physical location

c. You agree that your Submission uses only those elements of the Licensed Property that Licensor has expressly identified as eligible for Submissions.

d. You acknowledge and agree that Licensor may revoke its license at any time in whole or in part without notice to you, at which point you will no longer be authorised to use the Licensed Property, no additional sales of your Submission will be permitted, and your Submission may be removed from the Neopets Fan Art Program. You further acknowledge and agree that Licensor is granting you a license, versus any ownership in any right, title or interest.

e. Without limiting any other terms and conditions in the Agreement, if at any time Licensor elects, in its sole discretion, to use your Submission outside of the Neopets Marketplace, including to sell or offer it for sale outside of the Neopets Marketplace, you agree to negotiate with Licensor in good faith to transfer the applicable rights to Licensor, including ownership rights as applicable and to execute and deliver all appropriate agreements and other materials to effectuate or memorialise the foregoing. You agree that any payment or other consideration and negotiations between you and Licensor in connection therewith do not alter, modify or vary the Agreement in any manner whatsoever, do not alter the ownership rights in the Licensed Property and do not impair any of Licensor’s rights under the Agreement. The provisions of this paragraph will survive termination of the Agreement.

f. You agree to provide any details regarding your Submission, including use of any on-screen talent associated with the Licensed Property.

g. You agree to include any applicable or necessary legal lines or notices on or in the Submissions you create, as required under the Licensed Property User Guidelines.

h. Further, you agree that if your profit reaches above USD $2,000 per month or USD $20,000 per annum, you are required to contact Neopets to apply to become an official licensee. You will no longer be eligible for this program.

3. Your Representations & Warranties

a. You represent and warrant that (i) you have the sole and exclusive right and authority to grant the rights and perform the obligations in the Agreement; and (ii) the reproduction, publishing, displaying, and/or any other use of the Submission by Licensor, Neopets or other authorised parties as contemplated by the Agreement, including the Neopets User Agreement, will not infringe on any rights of third parties, including, without limitation, intellectual property rights, publicity rights or similar rights of a third party, or create claims for defamation, false light, idea misappropriation, intentional or negligent infliction of emotional distress, or breach of contract.

4. Intellectual Property

a. You acknowledge and agree that (i) the Licensor owns the Licensed Property, (ii) you have no rights, title or interest in or to the Licensed Property, (ii) all use of the Licensed Property by you shall inure to the benefit of Licensor, and (iii) you shall assign, and do hereby irrevocably assign, to Licensor any and all right, title and interest in all intellectual property and proprietary rights which you may acquire in the Licensed Property in connection with your Submission. The provisions of this paragraph will survive termination of the Agreement.

b. If you submit a Submission to the Neopets Fan Art Program and it is approved, Licensor grants you a limited, non-exclusive, non-sublicensable license to use of the Licensed Property in your Submission for the sole purpose of selling, offering for sale and promoting your Submission on the Neopets Fan Art Program; provided that you agree to and comply with the Agreement.

c. You agree and do hereby: (a) waive any and all claims you have, or may have in the future, against Licensor, Neopets, and their respective affiliates arising from, relating to, or with respect to your Submission, the Licensed Property and/or the Agreement, and (b) release and discharge Licensor, Neopets, and their respective affiliates from, and covenant not to sue for, any and all claims, causes of action, damages or detriments which in any way relate to or arise from your Submission, the Agreement, and/or your use of the Licensed Property. The provisions of this paragraph will survive termination of the Agreement.

d. You consent to the use of your name, addresses (city and state) and video and photographs of your name and likeness without further compensation or notification in any publicity, promotion or advertising in connection with the Submission in any media format worldwide in perpetuity, except where prohibited by law. The provisions of this paragraph will survive termination of the Agreement.

5. Indemnification

a. You agree to indemnify and forever hold harmless Licensor, Neopets, and their respective licensors, successors, assigns, parents, subsidiaries, directors, officers, employees, agents, partners, marketing affiliates, advisors, shareholders, and representatives (collectively, the “Released Parties”), from and against any costs, losses, judgments, awards, damages and expenses (including reasonable attorney’s fees) related to any action, suit, claim or proceeding made, brought or threatened by a third party, including, without limitation, amounts paid in settlement, attorneys’ fees, court costs and other legal expenses arising out of, connected with, and/or relating to (i) your Submission, (ii) your breach of the Agreement, and (iii) your unauthorised use of third-party materials and/or third-party intellectual property rights in connection with your Submission. The provisions of this paragraph will survive termination of the Agreement.

6. Termination

a. Failure to comply with the Agreement may result in the immediate termination of the Agreement and the licenses granted herein, removal of your Submission from the Neopets Marketplace, suspension of your user account, and other penalties, as determined by Neopets or Licensor, as applicable, in their sole discretion.

7. Limitation of Liability

a. You agree that in any arbitration or court action hereunder, the damages that may be awarded will be limited to any actual damages suffered. In no event will the released parties or any of their respective affiliates be liable for any special, incidental, consequential, exemplary or punitive damages, or any claim for loss of profits, lost business or lost business opportunities, even if it has been advised of the possibility of such damages.

b. You will have no rights to enjoin or prevent licensor from taking any act or actions in connection with the licensed property or use of your submission.

8. Miscellaneous

a. In the event of any conflict between these terms and conditions, the Artist Guidelines, and/or the Neopets User Agreement, these terms and conditions will prevail.

b. Neopets and Licensor reserve the right, exercised in their sole discretion, to update, change or replace any part of these terms and conditions, the Artist Guidelines, and/or the Neopets User Agreement by posting updates or modifications on the Neopets Marketplace. It is your responsibility to check this page and the Neopets User Agreement periodically for changes. Your continued use of or access to the Neopets Marketplace following the posting of any changes constitutes your acceptance of those changes.

c. If any provision of these terms and conditions is found illegal or unenforceable, it will be enforced to the maximum extent permissible, and the legality and enforceability of the other provisions of the Agreement will not be affected.

d. Any rule of construction to the effect that ambiguities are to be resolved against the drafting party shall not be applied in the construction or interpretation of these terms and conditions.

e. These terms and conditions, the Artist Guidelines, and the Neopets User Agreement, constitute the entire agreement regarding its subject matter and supersedes any and all prior or contemporaneous agreements, understandings, representations or statements of either party, whether by conduct, oral or in writing.
